AN ORDINANCE AMENDING ARTICLE 10, SECTION 1009(c)(5) MINIMUM LOT AREA OF THE LAND USE ORDINANCE OF THE BOROUGH OF MOUNTAINSIDE
WHEREAS, the Mayor and Council of the Borough of Mountainside, County of Union, and State of New Jersey have determined that there is a need to amend a section of the Land Use ordinance to address certain circumstances for when a subdivision is proposed. NOW THEREFORE BE IT ORDAINED by the Mayor and Council as follows: Article 10, Section 1009(c)(5) of the Borough Code is hereby amended by adding a new paragraph as follows: Any proposed subdivision of three or more lots shall have a minimum lot area of 20,000 sq ft and shall be further adjusted in accordance with critical area provisions set forth in section 1003(z) of this ordinance. AND BE IT FURTHER ORDAINED THAT all ordinances or parts of ordinances inconsistent with the provision of this ordinance are hereby repealed to the extent of such inconsistency.
