PUBLIC HEARING ON INVESTIGATION OF WHETHER CENTRAL VALLEY AREA INVESTIGATION IN NEEDS STUDY AREA (AINS) IS A NON-CONDEMNATION REDEVELOPMENT AREA OR AN AREA IN NEED OF REHABILITATION Pursuant to N.J.S.A. 40A:12A-6 et seq., the City of Orange Township Municipal Council, by Resolutions 143-2017 dated April 25, 2017; 270-2017 dated August 2, 2017; 99-2018 dated April 3, 2018; 169-2018 dated June 6, 2018; 267-2018 dated August 22, 2018, and 48-2020 dated February 4, 2020 has authorized the Orange Planning Board to undertake a preliminary investigation to determine whether the study area described below is a Non-Condemnation Redevelopment Area or an Area in Need of Rehabilitation (as such terms are defined within the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq.). If there is a determination that the study area qualifies as a Non-Condemnation Redevelopment Area, that redevelopment area determination shall not authorize the municipality to exercise the power of eminent domain to acquire any property in the study area. The map and the study can be inspected at the office of the City of Orange Township Municipal Clerk. A copy of the notice shall be published in a newspaper of general circulation in the municipality once each week for two consecutive weeks, and the last publication shall be not less than ten days prior to the date set for the hearing. A copy of the notice shall be mailed at least ten days prior to the date set for the hearing to the last owner, if any, of each parcel of property within the area according to the assessment records of the municipality. A notice shall also be sent to all persons at their last known address, if any, whose names are noted on the assessment records as claimants of an interest in any such parcel. Failure to mail any such notice shall not invalidate the investigation or determination thereon.
