EAST ORANGE NOTICE OF PUBLIC SALE OF CO-OP APARTMENT

Notice is hereby given that by reason of a default under a mortgage and loan/security agreement dated August 11, 2005 given by Yorlenis Alexis (“Debtor”) and held by Ditech Financial, LLC, pursuant to Article 9 of the Uniform Commercial Code, the Secured Party will sell the collateral described below at a PUBLIC AUCTION on December 21, 2018 at 2:00 p.m. at the offices KML Law Group, P.C. The sale is subject to dues and fees payable to the Corporation, continuing dues and fees, any costs associated with the transfer of the stock, and all real estate taxes due. The purchase price of the Collateral shall be the highest bid and shall be payable by certified or bank check with twenty (20) per cent payable at the time of deposit and the balance paid within thirty (30) days thereafter. Secured Party may bid at the sale and shall not be required to post any deposit but may credit bid against the purchase price all sums due it under the mortgage and loan or security agreement. If the successful bidder fails to deliver the balance timely, Secured Party may re-sell the Collateral as it shall determine and shall be entitled to retain the deposit. The sale is also subject to such additional conditions as may be announced at the start of the public auction. The Secured Party reserves the right to adjourn, delay or terminate the sale. Debtor may redeem the Collateral up to the date of the sale by payment in certified funds to the attorney for the Secured Party of all amounts due to the Secured Party. The co-op apartment is sold in "AS IS" condition, subject to superior liens, if any, subject to the rights of tenants in possession, if any, and subject to the rights of the co-operative Corporation. Possession of the apartment unit and approval of the co-operative Board of Directors or Corporation must be obtained by the purchaser at his or her own expense and effort.
