ORDINANCE AMENDING THE 2015 EAST ORANGE TRANSIT VILLAGE DISTRICT REDEVELOPMENT PLAN PURPOSE:
Amending the 2015 East Orange Transit Village District Plan Public Notice is hereby given that at a Regular Meeting of the East Orange City Council held on Monday, March 11, 2019, the following Ordinance was Introduced and passed on First Reading and that said Ordinance will be taken up for further consideration and final passage at a Meeting of the East Orange City Council to be held on Monday, April 8, 2019 at 6:00 PM at East Orange City Hall, 44 City Hall Plaza, East Orange, NJ in City Council Chambers WHEREAS, on June 22, 2015, the East Orange City Council (the "Council") adopted Resolution I-155 referring to the East Orange Planning Board (the "Board") for review, the East Orange Transit Village District Redevelopment Plan (the "TVD Redevelopment Plan") pursuant to the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq. (the "Redevelopment Law"); and WHEREAS, on November 16, 2015, the Board, after due notice and hearing as required pursuant to the Redevelopment Law adopted Resolution PB 650-15 finding that the TVD Redevelopment Plan is consistent with the City's Master Plan and recommending adoption of the TVD Redevelopment Plan; and WHEREAS, on December 28, 2015, the Council adopted Ordinance 57 of 2015 adopting the TVD Redevelopment Plan; and WHEREAS, the Council desires to amend the TVD Redevelopment Plan to add the Brick Church Plaza District (BCP), which includes Block 680, Lot 1, and Block 683, Lots 1, 1.01, 4.01, 4.02, and 5 on the Official Tax Maps of the City of East Orange (the "Brick Church Plaza District"), and to provide zoning regulations applicable only to properties within the Brick Church Plaza District (the "Redevelopment Plan Amendment"); and WHEREAS, the Council referred the Redevelopment Plan Amendment to the Board for review pursuant to the Redevelopment Law; and WHEREAS, the Board reviewed the Redevelopment Plan Amendment and found that the Redevelopment Plan Amendment is consistent with the City's Master Plan and recommends adoption of the same; and WHEREAS, the Council desires to adopt the Redevelopment Plan Amendments as specifically set forth below, NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the City Council of the City of East Orange, in the County of Essex, State of New Jersey as follows: I. GENERAL The aforementioned recitals are incorporated herein as though fully set forth at length. II. AMENDMENTS TO TVD REDEVELOP- MENT PLAN (a) Article 4, General Provisions, Section 4.2, Transit Village Boundaries, paragraph 1, of the TVD Redevelopment Plan is hereby supplemented with the addition of the following at the end of the paragraph: j. BCP: Brick Church Plaza District. (b) Article 5, Land use and Bulk Regulations, of the TVD Redevelopment Plan is hereby amended to add section 5.13, Brick Church Plaza District, which shall read as provided in Exhibit A. (c) The maps attached to the TVD Redevelopment Plan, which are attached as Exhibits 2, 3, 4, 5, 6, 7, and 8 to the TVD Redevelopment Plan, are hereby amended to include Block 680, Lot 1, and Block 683, Lots 1, 1.01, 4.01, 4.02 and 5 within the BCP Brick Church Plaza District. (d) Article 9, Appendix, Appendix A, Redevelopment Plan: Block and Lot Numbers by Sub-District, of the TVD Redevelopment Plan is hereby amended to remove Block 680, Lot 1, and Block 683, Lots 1, 1.01, 4.01, 4.02 and 5 from the CBD District and add them to the BCP District. (e) Article 9, Appendix, Appendix B, Redevelopment Plan: Block and Lot Numbers by Sub-District, of the TVD Redevelopment Plan is hereby amended to remove Block 680, Lot 1, and Block 683, Lots 1, 1.01, 4.01, 4.02 and 5 from the Central Business District and add the Brick Church Plaza District to include Block 680, Lot 1, and Block 683, Lots 1, 1.01, 4.01, 4.02 and 5. III. SEVERABILITY AND APPLICABILITY If any part of this Ordinance shall be deemed invalid, such parts shall be severed and the invalidity thereby shall not affect the remaining parts of this Ordinance. Any portion of the TVD Redevelopment Plan not modified by Section II of this Ordinance shall remain in full force and effect. IV. ZONING MAP The zoning map of the City is hereby amended to incorporate the revisions set forth in Section II of this Ordinance. V. AVAILABILITY OF THE ORDINANCE A copy of this Ordinance shall be available for public inspection at the offices of the City. VI. EFFECTIVE DATE This Ordinance shall take effect according to law.
