At a meeting of the Township Council of Bloomfield, County of Essex, New Jersey, held in the Council Chambers, 1 Municipal Plaza, Bloomfield, NJ, on July 19, 2021 at 6:30 p.m. prevailing time, the following Ordinance was passed on first reading. The Governing Body introduced the Ordinance. AN ORDINANCE TO AMEND AND SUPPLEMENT CHAPTER 387 OF THE BLOOMFIELD TOWNSHIP CODE, PROVIDING PARKING FOR PHYSICALLY LIMITED PERSONS (removal) BE IT ORDAINED, by the Mayor and Council of the Township of Bloomfield, County of Essex, State of New Jersey, as follows: Section 1. Chapter 387, entitled: “PARKING FOR HANDICAPPED”, Section 387-4, “Enumeration of restricted parking areas”, of the Code of the Township of Bloomfield is hereby amended by the deletion of the following: Jerome Place, south side starting point 397 feet from the Westerly curb line of Berkeley Avenue and running 20 feet west therefrom (165 Jerome Place) Baldwin Street, south side starting point 59 feet East of the Easterly curb line of North Spring Street and running 20 feet East therefrom (175 Baldwin Street) Willard Avenue, starting at a point 565 feet south of the Southerly curb line of Franklin Street and running 20 South therefrom (125 Willard Avenue) Willard Avenue, starting at a point 813 feet north of the Northerly curb line of Bloomfield Avenue and running 20 South therefrom (81 Willard Avenue) Section 2. AN ORDINANCE TO AMEND AND SUPPLEMENT CHAPTER 387 OF THE BLOOMFIELD TOWNSHIP CODE, PROVIDING PARKING FOR PHYSICALLY LIMITED PERSONS BE IT ORDAINED, by the Mayor and Council of the Township of Bloomfield, County of Essex, State of New Jersey, as follows: Section 1. Chapter 387, entitled: “PARKING FOR HANDICAPPED”, Section 387-4A “Enumeration of restricted parking areas”, of the Code of the Township of Bloomfield is hereby amended by the addition of the following: (638) 89 Broughton Avenue, east curb, starting at a point 46 feet North of the Easterly curb line, North of Howard Street and running 20 feet East therefrom. AN ORDINANCE TO AMEND CHAPTER 196, DRUG PARAPHERNALIA WITHIN THE TOWNSHIP CODE OF THE TOWNSHIP OF BLOOMFIELD BE IT ORDAINED, by the Mayor and Council of the Township of Bloomfield, County of Essex, State of New Jersey, as follows: SECTION 1. The following Section of Chapter 196, Drug Paraphernalia, § 196-1 “Prohibited activities” the Code of the Township of Bloomfield, County of Essex, State of New Jersey is hereby amended to read as follow: § 196-1 Prohibited activities. A. No person shall advertise, display, sell or offer to sell any type of syringe, needle, eyedropper, spoon, pipe, testing kit, rolling paper or other paraphernalia or appliances designed for or ordinarily used in smoking, testing, weighing, measuring, injecting, cooking or sniffing cocaine, opium, hashish or other controlled dangerous substances as defined by N.J.S.A. 24:21-1 et seq. B. No person shall maintain any buildings, conveyance or premises whatsoever which is resorted to by persons for the sale, manufacture, distribution, display, dispensing, administration or use of any type of syringe, needle, eyedropper, spoon, pipe, testing kit, rolling paper or other paraphernalia or appliances designed for or ordinarily used in smoking, testing, weighing, measuring, injecting, cooking or sniffing cocaine, opium, hashish or other controlled dangerous substances as defined by N.J.S.A. 24:21-1 et seq. C. The use, manufacture, distribution, sale and delivery of a controlled form of marijuana called “cannabis” shall be regulated within Chapter 315 of this Code, pursuant to P.L. 2021 c.16, as updated and amended, and those regulations promulgated by the New Jersey Cannabis Regulatory Commission. SECTION 2. All ordinances inconsistent herewith are hereby repealed. SECTION 3. NOTICE OF PUBLIC HEARING Township of Bloomfield County of Essex, State of New Jersey

PLEASE TAKE NOTICE that Ann Lauda ("Applicant") filed an application before the Township of Bloomfield Zoning Board of Adjustment for a use variance pursuant to NJSA 40:55D-70(d)(1), density variance pursuant to NJSA 40:55D-70(d)(5) and variances for front yard set back of 10.4 feet whereas 20 feet is required, building coverage of 36.5% whereas 25% is the maximum building coverage allowable, lot coverage of 77.8% whereas 60% is the maximum lot coverage allowable, 6 parking spaces whereas 8 parking spaces are required and preliminary and final site plan approval. The Applicant proposes to demolish the existing dwelling located on the premises and construct a multi-family home with four apartments while retaining the detached three (3) car garage and constructing (3) additional parking spaces. The Property which is subject to this application is located on the property designated on the municipal Tax Maps as Lot 3 in Block 249, located at 65 Park Avenue, Bloomfield, New Jersey (the "Property"). The Property is located in the R-1B Zoning District, which only permits single family residential use.
